Overview

Cosmetics market in India is growing at a rapid pace. The demand for cosmetics products has been growing, particularly in urban centres owing to several factors such as greater purchasing power because of higher incomes, increasing influence of western culture, desire to look better and more attractive etc. Cosmetics is also a sector that needs to be strictly regulated. As per the Drug and cosmetic act 1940, “cosmetic” means any article intended to be rubbed, poured, sprinkled or sprayed on, or introduced into, or otherwise applicated to, the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering the appearance, and includes any article intended for use as a component of cosmetic.

Cosmetics products in India are regulated under the Drugs and cosmetics Act 1940 and Rules 1945 and Labeling Declarations by Bureau of Indian Standards (BIS). BIS sets the standards for cosmetics for the products listed under Schedule ‘S’ of the Drugs and cosmetics Rules 1945.
All imported cosmetic products covered under definition of cosmetic are regulated under the provision of Drugs and Cosmetics Act, 1940 and Rules, 1945.
Drugs Controller General (India), Central Drugs Standard Control Organization (CDSCO regulate the import of cosmetics in India.

SCHEDULE S STANDARDS FOR COSMETICS

The following cosmetics in finished form shall conform to the Indian Standards specifications laid down from time to time by the Bureau of Indian Standards (BIS)

Requirements for import of Cosmetics in India

For the import of Cosmetics into India, the imported cosmetic products and manufacturing site are to be registered with Central Drugs Standards Control Organization by submitting an application in Form 42 to obtain Registration Certificate in Form 43.
Form 42 is an application for grant of a Registration Certificate for Import of cosmetics into India under the Drugs and Cosmetics Rules, 1945.
Form 43 is a Registration certificate to be issued for Import of cosmetics into India under the Drugs and Cosmetics Rules, 1945.

COSMETIC- AUTHORIZED AGENT/ REGISTRATION HOLDER SUPPORT

An “Authorized Agent” means a person or entity in India authorized by the manufacturer. The authorized agent will be responsible for the business activities of the manufacturer in India including compliance to the provisions of the Act in all respects.
The appointed Authorized Representative is also responsible for pre-certification and post-market surveillance inquiries.
Only one Indian Authorized Representative office is needed for the whole country.

Who can apply for Registration of Import of Cosmetics / who can be an importer

(i) The Manufacturer himself having registered office in India.
(ii) The Authorised Agent of the Manufacturer
(iii) The Subsidiary of the Manufacturer
(iv) Any other importer
